Earthworks Industries, Inc. (the “Company”) reports that the Company’s wholly owned U.S. subsidiary, Cortina Integrated Waste Management Inc., (“CIWM”) has filed a Complaint in the U.S District Court for the Eastern District of California, challenging the Order of the U.S. Department of the Interior’s, Interior Board of Indian Appeals (IBIA), which purports to cancel the federally approved lease between CIWM and the Kletsel Dehe Wintun Nation of the Cortina Rancheria, California.
The Court has set a Status (Pretrial Scheduling) Conference for June 2, 2025.
CIWM and the United States (“U.S.”) Department of the Interior, U.S. Bureau of Indian Affairs and Interior Board of Indian Appeals (“Federal Defendants”) and Defendant-Intervenor Kletsel Dehe Wintun Nation of the Cortina Rancheria (“Tribe”) have conferred and jointly submitted their March 31, 2025, Joint Status Report and Scheduling Proposal for the Court’s consideration.
By filing that March 31, 2025, Joint Status Report, Counsel for the parties submitted their joint proposal for the briefing schedule, requesting that the Court approve the following schedule:
Federal Defendants lodge Administrative Record by April 4, 2025.
CIWM’s Motion and Supporting Memorandum by May 16, 2025.
Federal Defendants’ Opposition / Cross-motion by June 30, 2025.
Defendant-Intervenor’s Opposition / Cross-motion by June 30, 2025.
CIWM’s Reply / Opposition by July 30, 2025.
Federal Defendants’ Cross-motion Reply by August 29, 2025.
Defendant-Intervenor’s Cross-motion Reply by August 29, 2025.
Unless the Court orders otherwise, the matter will be deemed submitted for decision on the day after
the last brief. Should the Court prefer to set an argument date, the parties have respectfully informed
the Court that they are available for a hearing on the motions on October 6, or 27, 2025, or such other
date that is convenient for the Court after September 2025.
The parties await issuance by the Court of its Status (Pretrial Scheduling) Order pursuant to the March 31, 2025, Joint Status Report.
